Potentially dangerous animals

Royal Decree 287/2002 of 22nd of March in which is developed the Law 50/1999 of 23rd of December about the legal regime of possession of potentially dangerous animals are set the characteristics of the animals which should be classified as such.

1. ANIMALS OF CANINE SPECIES POTENTIALLY DANGEROUS.
Annex I (RD 287/2002)

  • Pit Bull Terrier
  • Staffordshire Bull Terrier
  • American Stafforshire Terrier
  • Rottweiler
  • Dogo Argentino
  • Fila Brasileño
  • Tosa Inu
  • Akita Inu

2. SPECIFIC CHARACTERISTICS OF DOGS CONSIDERED TO BE POTENTIALLY DANGEROUS. Annex II ( RD 287/2002)
Dogs affected by the present regulation have all or most of the following characteristics:

  • Strong musculate, powerful and robust appearance, athletic constitution, agility, energy and endurance.
  • Strong character and great bravery.
  • Short fur.
  • Thoracic perimeter between 60 and 80 cm, height at the withers between 50 and 70 cm, weight over 20 kg.
  • Large, robust, cuboide head with broad and big skull and prominent and muscular cheeks, strong and big jaw, strong broad and deep mouth.
  • Broad and muscular neck.
  • Strapping, broas, big and deep chest, arched ribs and muscular and short back.
  • Straight, parallel and strong forelegs, very muscular hindquarters with relatively long legs forming a moderate angle.

3. REQUIREMENT TO OBTAIN THE LICENCE FOR POTENTIALLY DANGEROUS ANIMALS
Municipal licence for possession of potentially dangerous animals. Personal requirements (art 3 RD 287/2002):

  • Prove majority of the applicant (provide original DNI and photocopy).
  • Certificate of not having been convicted for crimes of homicides, injuries, tortures against moral integrity, sexual freedom and public health, armed band association or drug trafficking, as well as not have been deprived of the right to possession of potentially dangerous animals by court decision.
    It's obtained in the Gerencia Territorial del Munisterio de Jusitica, C/ Posada de la Real, de Palma.
  • Certificate of not having been fined for serious or very serious infringement with some of the supplementary punishment planned in the Law 50/1999, of 23rd of December about the legal system of possession of potentially dangerous animals.
    It's obtained in the Conselleria d' Agricultura i Pesca del Govern Balear, c/ Foners 10, of Palma.
  • to have the physical and psicological capacity for the possession of potentially dangerous animals.
    It can be obtained in any medical examination center approved according to RD 2272/1985, of 4th of December.
  • A civil liability insurance certificate for damages to third-party with a minimum coverage of 120,000 € (provide the policy) in force (provide the premium corresponding to the period in force) has to be formalized.
    It can be obtained in any insurance company legally established in the Spanish State.

Requirements Law 50/ 1999, of 23rd of December (art 6):

  • Animal health certificate for dogs make by a veterinary surgeon. It can be obtained from any veterinary surgeon who is registered in the veterinarian association.
  • Once obtained the licence, the licence holder must apply for registration in the Municipal Register of potentially dangerous animals. This procedure can be carried out in any General Registry of Citizen Services office (OAC).
